Hon.<\/span><span class=\"s2\"> [Dr.]<\/span> <span class=\"s2\">Mudashiru<\/span> <span class=\"s2\">Ajayi <\/span><span class=\"s2\">Obasa<\/span><\/p>\n<p class=\"s4\"><span class=\"s2\">The Speaker<\/span><\/p>\n<p class=\"s4\"><span class=\"s2\">Lagos State House of Assembly<\/span><\/p>\n<p class=\"s4\"><span class=\"s2\">Assembly Complex<\/span><\/p>\n<p class=\"s4\"><span class=\"s2\">Alausa Ikeja.<\/span><\/p>\n<p class=\"s4\"><span class=\"s2\"><br \/>\n<\/span>Dear Sir,<\/p>\n<p class=\"s6\"><span class=\"s5\">C<\/span><span class=\"s5\">omposition of Lagos State Executive Council: The Imperative\u00a0<\/span>of Constitutional Compliance<\/p>\n<div class=\"s8\">1. <span class=\"s7\"><span class=\"bumpedFont15\">We are Solicitors to The Companion<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">, a frontline association of Muslim men in business and the professions,<\/span><\/span> <span class=\"s7\"><span class=\"bumpedFont15\">at which behest we have been requested to write<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> to the Lagos State House of Assembly in respect of the above subject.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s8\">2. <span class=\"s7\"><span class=\"bumpedFont15\">Our Client <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">was established in 1984<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> in Lagos State and s<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">ince inception, has been focused on propagation and <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">enlightenment<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> education<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">economic empowerment<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> political <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">empowerment<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> and community engagement.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s8\">3. <span class=\"s7\"><span class=\"bumpedFont15\">It has been brought to our Client\u2019s attention that<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> the Governor of Lagos State,<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> His Excellency, Mr. Babajide <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">Sanwo<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">-Olu has forwarded a list of nominees for consideration for appointment as Commissioners <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">and Special Advisers <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">in the State to the House of Assembly under your distinguished leadership.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s8\">4. <span class=\"s7\"><span class=\"bumpedFont15\">It is <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">the understanding of our Client <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">that out of the 39 names presented by the Governor, only 8 are Muslim<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">.<\/span><\/span> <span class=\"s7\"><span class=\"bumpedFont15\">Our Client is of the view that a cabinet of 39 with only 8 Muslim<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">, which is less than 21%, <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">is not only discriminatory against <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">Muslim voters and citizens in Lagos State, it is also unconstitutional. The proposed nomination<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">which is heavily weighted against the interest<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">of Muslims in Lagos State<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> is contrary to the Constitution of the Federal Republic of Nigeria 1999 <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">(as amended) (hereafter <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">referred to as \u201cthe Constitution) <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">which expressly<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> by its section 42<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> guarantee<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> the right of every Nigerian citizen <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">to <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">freedom from discrimination on ground of religion, amongst others.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s8\">5. <span class=\"s7\"><span class=\"bumpedFont15\">Mr. Speaker Sir, may we respectfully draw Your Excellency\u2019s <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">attention<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> to the provision of section 14(4) of the Constitution which is categorical and unequivocal about <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">the composition of a cabinet<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> or any agency<\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\"> of a State Government. The section provides that: <\/span><\/span><\/div>\n<p class=\"s10\"><span class=\"s9\"><span class=\"bumpedFont15\">(4) The composition of the Government of a State, a local government council, or any of the agencies of such Government or council, and the conduct of the affairs of the Government or council or such agencies shall be carried out in such manner as to recognise the diversity of the people within its area of authority and the need to promote a sense of belonging and loyalty among all the peoples of the Federation.\u201d<\/span><\/span><\/p>\n<div class=\"s12\"><span class=\"s11\">6. <\/span><span class=\"s9\"><span class=\"bumpedFont15\">It is our position that having 8 Muslims as Commissioners in Lagos State fails the constitutional prescription of recognising the diversity of the good people of Lagos State. It also does not promote a sense of belonging and loyalty among Muslims of Lagos State.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s12\"><span class=\"s11\">7. <\/span><span class=\"s9\"><span class=\"bumpedFont15\">Our Client\u2019s position is further cemented by the provision of section 192(2) of the Constitution which provides that: <\/span><\/span><\/div>\n<p class=\"s13\"><span class=\"s9\"><span class=\"bumpedFont15\">\u201c(2) Any appointment to the office of Commissioner of the Government of a State shall, if the nomination of any person to such office is confirmed by the House of Assembly of the State, be made by the Governor of that State and in making any such appointment the Governor shall conform with the provisions of section 14(4) of this Constitution.\u201d<\/span><\/span><\/p>\n<div class=\"s14\"><span class=\"s11\">8. <\/span><span class=\"s9\"><span class=\"bumpedFont15\">Mr. Speaker Sir, as a distinguished lawmaker<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">who has earned his stripes in parliamentary leadership, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">and <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">as <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">a <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">member of the <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Nigerian<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Bar,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> your Excellency is aware that the provision of section 192(2) is mandatory and it must be complied it. <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">This provision empowers the distinguished House of Assembly you are privileged to lead to ensure that the <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">act of the <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Governor<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, in this regard,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> conforms <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">to<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> the provisions of section 14(4) of the Constitution which we have taken the liberty to reproduce above.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s14\"><span class=\"s11\">9. <\/span><span class=\"s9\"><span class=\"bumpedFont15\">Mr. Speaker, you will recall that on 29 May 2023, His Excellency, Mr. Babajide <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Sanwo<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">-Olu took <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">the <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Oath of Office as the Governor of Lagos State as contained in <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">the <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Seventh Schedule to the Constitution of the Federal Republic of Nigeria to the effect, amongst others, that he \u201cwill strive to preserve the Fundamental Objectives and Directive Principles of State Policy contained in the Constitution of the Federal Republic of Nigeria\u201d.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s14\"><span class=\"s11\">10. <\/span><span class=\"s9\"><span class=\"bumpedFont15\">It is<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> therefore<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> our Client\u2019s position that the Lagos State House of Assembly should<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> as a matter of constitutional imperative, good conscience, fairness and equity<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> advise His Excellency, Governor Babajide <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Sanwo<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">-Olu to com<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ply<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> with the provisions of section 14(4), section 42, section 192(2) and <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">the <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Seventh Schedule of the Constitution.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s14\"><span class=\"s11\">11. <\/span><span class=\"s9\"><span class=\"bumpedFont15\">Our Client is confident that the Lagos State House of Assembly<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> with its avowed commitment to be the leading light and pathfinder for Nigerian legislatures<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> will ensure that the Constitution is observed in its entirety.<\/span><\/span><\/div>\n<div><\/div>\n<div class=\"s14\"><span class=\"s11\">12. <\/span><span class=\"s9\"><span class=\"bumpedFont15\">While o<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ur Client reserves its right<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s as guaranteed under the Constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, p<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">lease accept the assurances of our Client\u2019s highest regards.<\/span><\/span><\/div>\n<p
